Ten more reasons to oppose the Senate amnesty bill (S.1348)

(besides its codification of E.O. 13166)

(Note: this memo refers to the Senate version of the bill made available to the public on May 19, 2007.)

(1) One-fifth fewer agents on the Mexican border than you think

Subtitle A, Section 101 requires the hiring of 2400 new full time Border Patrol agents per year for six years FY 2007 -2012, but 20% of these new agents hired from 2008- 2012 must be stationed on Canadian border.

(2) Instant Amnesty

(h) Treatment of Applicants-

10 (1) IN GENERAL- An alien who files an application for Z

11 nonimmigrant status shall, upon submission of any

12 evidence required under paragraphs (f) and (g) and after

13 the Secretary has conducted appropriate background

14 checks, to include name and fingerprint checks, that have

15 not by the end of the next business day produced

16 information rendering the applicant ineligible .

18 (A) be granted probationary benefits in the form of

19 employment authorization pending final adjudication

20 of the alien' application

(3) Interior Enforcement Discouraged

SEC. 136. COMBATING HUMAN SMUGGLING.

(d) Savings Provision- Nothing in this section may be construed to provide additional authority to any State or local entity to enforce Federal immigration laws.

(4) U.S. must beg illegal aliens to accept amnesty in five languages

(q) Dissemination of Information on Z Program- During the 2

18 year period immediately after the issuance of regulations

19 implementing this title, the Secretary, in cooperation with

20 entities approved by the Secretary, shall broadly disseminate

21 information respecting Z classification under this section and the

22 requirements to be satisfied to obtain such classification. The

23 Secretary shall disseminate information to employers and labor

24 unions to advise them of the rights and protections available to

25 them and to workers who file applications under this section.

26 Such information shall be broadly disseminated, in no fewer than

27 the top five principal languages, as determined by the Secretary

28 in his discretion, spoken by aliens who would qualify for

29 classification under this section, including to television, radio,

30 and print media to which such aliens would have access.

(5) $30 million in immigration grant funds sent to nonstates

States and units of local government shall use "grant funds

[a minimum of $5 million per state] received under this

paragraph to provide health services, educational services ...

16 ' STATE DEFINED.-- In this paragraph, the term '' means

17 each of the several States of the United States, the District of

18 Columbia, the Commonwealth of Puerto Rico, the Virgin Islands,

19 Guam, American Samoa, and the Commonwealth of the Northern

20 Mariana Islands.

(6) This bill concedes there will still be future illegal immigration:

SEC. 121. DEATHS AT UNITED 1 STATES-MEXICO BORDER.

(b) Report- Not later than 1 year after the date of enactment of

9 this Act, and annually thereafter, the Commissioner of the Bureau of

10 Customs and Border Protection shall submit to the Secretary a report

11 that--

12 (1) analyzes trends with respect to the statistics collected

13 under subsection (a) during the preceding year; and

14 (2) recommends actions to reduce the deaths described in

15 subsection (a).

(7) Employers are required to pay Social Security taxes for guestworkers.

"a Y nonimmigrant is prohibited from being treated as an independent contractor under any federal or state law;

(8) This bill endorses the idea that illegal alien "migrants" have civil rights which the United States must enforce:

Sec. 138. UNITED STATES-MEXICO BORDER ENFORCEMENT

13 REVIEW COMMISSION.

13 (b) Duties-The Commission shall review, examine, and make

14 recommendations regarding border enforcement policies,

15 strategies, and programs, including recommendations regarding-

16 (1) the protection of human and civil rights of community

17 residents and migrants along the international border

18 between the United States and Mexico;

(9) Guest Workers allowed up to 60 consecutive days of unemployment

25 ' IN GENERAL- The period of authorized admission of a Y nonimmigrant

26 shall terminate immediately if:
